Terms of Service

These Terms of Service ("Terms") govern your access to and use of SharkCluster, a managed cloud hosting platform operated by Coreway Solution ("Company", "we", "us"). By creating an account or using our services, you agree to these Terms.

1. Service Description

SharkCluster is a managed cloud hosting control panel that allows you to provision, manage, and monitor virtual private servers (VPS) across multiple cloud infrastructure providers including but not limited to OVH, DigitalOcean, Contabo, and Vultr. We provide the management interface, automation layer, and DevOps support. The underlying servers are provided by third-party infrastructure providers under their own terms.

2. Account Registration

• You must be at least 18 years old to create an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must provide accurate and complete information during registration.
• One person or legal entity may not maintain more than one free account.
• You are responsible for all activities that occur under your account.

3. Acceptable Use

You agree NOT to use SharkCluster to:

• Host, distribute, or facilitate malware, spam, phishing, or DDoS attacks
• Mine cryptocurrency without explicit disclosure
• Store or distribute illegal content including pirated software or CSAM
• Violate any applicable local, national, or international laws or regulations
• Attempt to gain unauthorized access to other systems or accounts
• Resell or sublicense SharkCluster services without our written permission
• Abuse free trial offers or credits fraudulently

Violation of these terms may result in immediate suspension or termination of your account without refund.

4. Billing & Subscriptions

4.1 Plans

SharkCluster offers monthly and annual subscription plans. Plan details, pricing, and included resources are listed on our pricing page and may be updated from time to time.

4.2 Prepaid Credits

Some features operate on a prepaid credit wallet system. Credits are non-transferable between accounts and have no cash value.

4.3 Payment

All fees are charged in USD unless otherwise stated. Subscriptions renew automatically on the billing anniversary date. You authorize us to charge your payment method on file for recurring fees.

4.4 Failed Payments

If a payment fails, we will notify you and attempt to retry. Services may be suspended after 7 days of failed payment. We are not responsible for data loss due to non-payment-related suspension.

5. Third-Party Infrastructure Providers

SharkCluster acts as a management and automation layer over third-party server providers. We are not responsible for outages, data loss, or service interruptions caused by OVH, DigitalOcean, Vultr, Contabo, or any other infrastructure provider. You acknowledge that uptime guarantees are subject to those providers' SLAs.

When you connect your own provider API credentials, you grant SharkCluster permission to manage resources under that account solely as directed by your actions on the platform.

6. Service Availability

We strive for high availability of the SharkCluster control panel. Planned maintenance will be announced in advance. We do not guarantee 100% uptime of the management interface and are not liable for downtime not exceeding 4 hours per month.

7. Intellectual Property

All software, UI, branding, and content on SharkCluster is owned by Coreway Solution. You are granted a limited, non-exclusive, non-transferable license to use the platform for your own server management. You retain all rights to applications and data you deploy on your servers.

8. Data & Backups

You are solely responsible for maintaining backups of your data. SharkCluster may offer backup tools as a convenience feature, but does not guarantee the completeness or recoverability of backups. We are not liable for any data loss on servers you manage through our platform.

9. Limitation of Liability

To the maximum extent permitted by applicable law, SharkCluster and Coreway Solution shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption, arising from your use of or inability to use the service, even if advised of the possibility of such damages.

Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid to us in the 3 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Coreway Solution, its directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the platform, violation of these Terms, or infringement of third-party rights.

11. Account Termination

You may cancel your account at any time from the dashboard. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your access to the platform will cease and your server data may be deleted after a 15-day grace period.

12. Governing Law

These Terms shall be governed by the laws of the Republic of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.

13. Changes to Terms

We may update these Terms from time to time. Continued use of SharkCluster after the effective date of any update constitutes acceptance of the revised Terms. We will provide at least 14 days' notice for material changes via email or in-app notification.
